Timeline

Following a 2012 Constitutional Court of Guatemala decision upholding the domestic legal framework regulating radio license as constitutional and not discriminatory against indigenous peoples, activists and NGOs involved in the indigenous community movement decided to explore international human rights forums. With legal representation secured with the Human Rights and Indigenous Peoples Clinic at Suffolk University Law School, the US-based Cultural Survival and Guatemala-based Associación Sobrevivencia Cultural filed a petition with the Inter-American Commission on Human Rights in 2012 on behalf of four victim indigenous communities in Guatemala operating community radio stations. In 2020, the Commission issued its report finding that Guatemala violated the human rights of the victims and then took the step to transfer the case to the Inter-American Court of Human Rights. Following a hearing in June 2021, the Court released in judgment in December 2021.
